Accelerators are a way of helping new businesses to establish themselves.  They are short programmes that last between 4 and 12 months in which groups of entrepreneurs known as "cohorts" refine their business plans and are given the skills, knowledge and connections they need to succeed.  NESTA (the National Endowment for Science, Technology and the Arts) published a research paper and directory of accelerators and incubators last year which I discussed in Business Incubators and Accelerators Directory 20 April 2017 NIPC News.

On 22 April 2017 I discussed the Accelerators and Incubators in the Leeds City Region in IP Yorkshire and on the 24 I considered those in Sheffield in Accelerators and Incubators in the Sheffield City Region.  I also mentioned a new fintech accelerator in Dubai in FinTech in Dubai  3 Aug 2017 in NIPC Gulf.

Since a lot of inventors fail because they lack the skills and connections needed to convert their inventions into a business I wrote:

"I think something can be learned from business accelerators where fledgling businesses are offered office or lab space, mentored by experts, helped to refine their products or services and eventually introduced to investors" (see No Invention should be left behind here - the Case for Inventor Academies 27 Jan 2018 NIPC Inventors Club).

I was very pleased to read a few days later that the businesses shortlisted for the NESTA Inventor Prize would receive mentoring to improve their inventions at something that sounded very like an accelerator programme at Barclays Eagle Labs (see NESTA Inventor Prize Shortlist  31 Jan 2018 NIPC Inventors Club).

Meanwhile I have been able to follow the progress of a new healthcare accelerator in Bradford which launched on 8 Jan 2018 (see Northern Max - a new Healthcare Accelerator in Bradford 12 Jan 2018 IP Yorkshire). That programme will come to an end on 29 March 2018 (see Bradford Healthcare Accelerator Programme comes to an End 26 March 2019 NIPC News) and held a demo day which I attended on 22 March 2018 (see NorthernMAX Demo Day 26 March 2018 IP Yorkshire).

Patents - Gilead Sciences Inc v NuCana Plc

  Jane Lamber t Patents Court  (Mr Justice Meade) G ilead Sciences Inc and another NuCana PLC  [2023] EWHC 611 (Pat) (21 March 2023) This was an action by Gilead Sciences Inc. and its British subsidiary Gilead Sciences Ltd ("Gilead") for revocation of two European Patents (UK) that had been granted to NuCana Plc ("NoCana"), namely  EP 2 955 190 B1 (“EP190”)  and   EP 3 904 365 B1 (“EP365”) .  NuCana complained that Gilead's product  sofosbuvir  infringed its patents. Mr Justice Meade, who tried the action, could see no real defence to the counterclaim if the claims of the patents were valid. Grounds of Revocation Gilead sought revocation of the patents on the following grounds: Added matter in that the  Markush group definitions of the claims  of the patents are not clearly and unambiguously disclosed in the original application; Lack of plausibility in that the Patents do not plausibly disclose any technical contribution common to substantially all the claimed

Copyright in Photographs: Temple Island Collections and Creation Records

In our very first NIPC newsletter which we published in June 1997 I wrote a case note on Mr. Justice Lloyd's decision in  Creation Records Ltd. and Others v News Group Newspapers Ltd   [1997] EMLR 444, [1997] EWHC Ch 370, (1997) 16 Tr LR 544. In that case Mr. Noel Gallagher of Oasis and others applied for an interlocutory injunction to restrain The Sun from offering for sale and selling a poster of Oasis that featured a photo of an elaborate set that included a white Rolls Royce in a country club swimming pool. The Sun's photograph was very similar to the photograph that appeared on an Oasis album cover. The similarity arose because The Sun's photographer shot the same scene at roughly the same time and from the same angle as Mr. Gallagher's photographer but he did not reproduce any part of Oasis's print or negative.
